These Terms of Service ("Terms") govern your use of voteforbarnett.com (the "Site"), the official website of Barnett for Magistrate, the political campaign committee supporting George Barnett ("we," "us," or "our"). Please read them carefully.
Acceptance of Terms
By accessing or using the Site, submitting a form, opting in to our messages, or making a contribution, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.
Eligibility
To make a contribution or use certain features, you must be able to lawfully do so. Among other things, you must be old enough to enter a contract in your jurisdiction, and any contribution you make must be permitted under Kentucky and federal campaign-finance law — including rules about who may contribute, contribution limits, and prohibited sources. The Site is intended for adults and is not directed to children under 16.
Use of the Site
You agree to use the Site lawfully and respectfully. You will not:
- Break any law or regulation, or encourage others to
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems
- Upload or transmit viruses, malware, or other harmful code
- Scrape, harvest, or collect information about other users
- Impersonate any person or misrepresent your affiliation
- Use the Site to harass, threaten, or defraud anyone
- Post or transmit content that is unlawful, defamatory, obscene, or infringing
We may suspend or block access to anyone who violates these Terms or misuses the Site.
Text Messaging (SMS) Program
If you provide your phone number and consent, we may send you calls and text messages about the campaign, including updates, events, volunteer opportunities, and requests for donations.
Consent is given through the disclosure shown when we collect your number: "By providing your telephone number and checking this box, you consent to receive calls and text messages. Msg & data rates may apply. Msg frequency may vary. Messaging may include requests for donation. Reply "STOP" to opt-out & "HELP" for help."
Key terms of the messaging program:
- Consent is not a condition of making a contribution, volunteering, or using the Site.
- Message frequency may vary.
- Message and data rates may apply from your carrier.
- To opt out, reply STOP to any message. For help, reply HELP or email [email protected].
How we handle your messaging opt-in data is described in our Privacy Policy, including our commitment not to share or sell your opt-in data except as required by law.
Contributions / Donations
Contributions to Barnett for Magistrate are processed by our third-party payment provider, Anedot, under its own terms of service and privacy policy. By contributing, you agree to those terms in addition to these.
Please note:
- Contributions are not tax-deductible as charitable contributions for federal income tax purposes.
- Contributions are subject to Kentucky and federal campaign-finance law, including contribution limits, source restrictions, and disclosure and reporting requirements. By contributing, you confirm that your contribution complies with those laws — for example, that it is made from your own funds, on your own credit card, and not on behalf of, or reimbursed by, another person or a prohibited source.
- Campaign-finance law may require us to publicly report information about you as a contributor, such as your name, address, occupation, employer, and contribution amount.
- We may be required to return or refund a contribution that does not comply with applicable law.

Intellectual Property
The Site and its content — including text, graphics, logos, images, and design — are owned by or licensed to Barnett for Magistrate and are protected by intellectual-property laws. You may view and share Site content for lawful, non-commercial, personal, and civic purposes, but you may not copy, modify, distribute, or use it commercially without our permission. The campaign's names, logos, and marks may not be used in a way that suggests endorsement or affiliation without our consent.
User Submissions
When you submit content through the Site — such as a form, message, comment, or other material ("Submissions") — you keep ownership of it, but you grant Barnett for Magistrate a non-exclusive, royalty-free, worldwide license to use, store, reproduce, and display that content to operate and promote the campaign, consistent with our Privacy Policy.
You are responsible for what you submit. You represent that your Submissions are truthful, are yours to share, and do not violate the law or anyone's rights. Do not submit confidential information or anyone else's personal information without their permission. We may remove Submissions and moderate comments on our social media pages as described in our Privacy Policy's Social Media & Comment Policy. We are not obligated to use, keep, or display any Submission.
Third-Party Links & Services
The Site may link to or embed third-party websites and services, including our donation processor, email provider, and social media platforms. We do not control those services and are not responsible for their content, practices, or terms. Your use of a third-party service is governed by that party's own terms and privacy policy.
Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site is complete or accurate at all times. Information on the Site is for general campaign and civic purposes and is not legal, financial, or voting advice.
Limitation of Liability
To the fullest extent permitted by law, Barnett for Magistrate, George Barnett, and their volunteers, staff, and vendors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Site — even if we have been advised of the possibility of such damages. To the extent any liability is not excluded, our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
Indemnification
You agree to indemnify and hold harmless Barnett for Magistrate, George Barnett, and their volunteers, staff, and vendors from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your Submissions, or your violation of these Terms or of any law or third-party right.
Governing Law
These Terms are governed by the laws of the State of Kentucky and applicable federal law, without regard to conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in Kentucky, and you consent to their jurisdiction.
Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Effective Date" above and post the revised Terms on the Site. Your continued use of the Site after an update means you accept the revised Terms.
